GENERAL POLICIES:

IceStorm.com™ provides global web hosting to many clients, and we have a responsibility to provide each and every client with the best possible service. The following guidelines have been established to insure this intent is met.

Content:
All services provided by IceStorm.com may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secrets and other statutes. IceStorm.com is not responsible for any claims resulting from the use of our service.

Note: Content that promotes any illegal activity or content that may be damaging to IceStorm.com servers or any other server on the internet is strictly prohibited. This also includes, but not limited to pirated software, illegally distributed MP3s, hacker programs/archives, and warez sites. Links to such materials are also prohibited. IceStorm.com will be the sole arbiter as to what constitutes a violation of these provisions.

Bandwidth Traffic Policies:
To maintain the integrity of our system, domains that go extremely beyond their traffic allowance will be automatically disabled without notice to protect current users on the system. Domains that may be susceptible to going over the traffic allowance usually house enormously large files (zips, ROMs, mp3s, graphic galleries) or domains that house multiple main web sites. Extra traffic may be purchased at discounted rates. IceStorm.com will notify the user ahead of time before any extra charges are applied.

Chat Rooms, IRC, and Proxy Servers:
We do not allow our clients to install their own custom chat scripts. This tends to hinder system resources. We do provide a choice of chat rooms that can be installed for free through the account's control panel. The chat rooms we provide will more than fill your needs without degrading the performance of the system for others. Furthermore, we currently DO NOT allow IRC or IRC bots to be operated on our servers. Accounts running proxy servers are not allowed.

Background running programs:
IceStorm.com does NOT allow programs to run continually in the background. Please ask permission first.

Spamming, Commercial Email Advertising:
Spamming, the sending of unsolicited email or posts, from ANY server is STRICTLY prohibited. Our servers may not be the source, intermediary, or destination address involved in the transmission of spam, flames, or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. We consider spam any mass unsolicited message in the mediums of Newsgroups and Email. If you are found to have spammed, then we will immediately, without warning, disable your domain. We reserve the right to refuse or cancel service to known spammers. Furthermore, we consider the selling for bulk email software on a hosted domain a violation of this policy. As such, any violation will result in immediate deactivation of services without refund. IceStorm.com will be the sole arbiter as to what constitutes a violation of this provision.

Resource Usage:
Any account using more than 15% of system CPU or memory resources, or any account that will overwhelmingly heighten the load of the entire server will automatically be suspended to protect existing clients on the server.

File Quotas
To maintain the quickness and stability of backing up data of our customers' domains, a file quota is implemented on some accounts. Please contact Support to find out your current file quota.

Server abuse:
Any attempts to undermine or cause harm to any IceStorm.com server or customer of IceStorm.com is strictly prohibited.

Money Back Guarantee:
IceStorm.com is proud to offer a 30 day money-back guarantee. Our 30 day money-back guarantee DOES NOT pertain to additional resold accounts, SSL Certificates, upgrades/add-ons, domain registrations, nor domain renewals. The 30 day money back guarantee ONLY pertains to the MAIN WEB HOSTING or MAIN RESELLER ACCOUNT. If you sign up for a NON-RESOLD HOSTING ACCOUNT and you are not completely satisfied within 30 days, we will refund the monthly fee associated with that account.

Payment Issues, Reactivations, Cancellations, and Refunds:
Payment of all domain accounts, including reseller and special domain accounts must be paid within 10 days of site activation or billing invoice due date. If an account is cancelled due to non-payment and the customer would like to reactivate the account with us, the remaining balance of what is owed plus a reactivation fee for each domain must be paid first. If the customer wants his/her files restored on their site from tape backup, an additional $75 restoration fee for each domain may be applied. If a customer wishes to discontinue using a web hosting account, the customer MUST contact IceStorm.com AND receive confirmation from us that the account was cancelled. Otherwise, the account may continue to be invoiced. Simply "not using" a web hosting account, or changing DNS information does not necessarily mean a customer wants service to be discontinued or cancelled. We do not cancel accounts in advance. We do not give out refunds with exception through our 30-day Money Back Guarantee.

DOMAIN NAME REGISTRATION POLICIES:

IceStorm.com™ registers all domains through an accredited registrar with the Internet Corporation for Assigned Names and Numbers ("ICANN"). ICANN oversees the .com, .org and .net top-level domains. All registration fees are non-refundable. IceStorm.com may at its sole discretion, elect to accept or reject any application for registration of domain name for any reason, including but not limited to, rejection due to a request for registration of a prohibited domain name. IceStorm.com is not liable or responsible for any errors, omissions, or other actions by the registry administrator arising out of or related to your application or receipt of, or failure to receive a domain name registration. You agree to indemnify, defend and hold harmless IceStorm.com, the registry administrator and their directors, officers, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees and expenses) arising out of or related to your domain name registration. To register .us domains, you must be a citizen of the United States or have a permanent residency within the United States.

DISCLAIMER:

IceStorm.com™ cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Although our technicians make every effort to backup each customer's account, we cannot guarantee backup restoration. Certain services provided by IceStorm.com are resold. Thus, certain equipment, routing, software, and programming used by IceStorm.com are not directly owned nor written by IceStorm.com. Moreover, IceStorm.com holds no responsibility for the use of our clients' accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to edit these policies without advance notice and reserve the right to remove any account without advanced notice for any reason IceStorm.com sees fit.

PRIVACY POLICY:

Privacy Commitment: Privacy is a critical issue to every Internet user and IceStorm.com™ is committed to assuring that the privacy and confidentiality of visitors to this site are respected and preserved. Unless you give us explicit permission, we will not share your personally identifiable information such as name, address or e-mail address with third parties for any purpose. Information gathered from your activity is used for compiling anonymous statistics only and is not identifiable back to any individual. Registration information is used for verification purposes, for sending administrative e-mails to clients regarding our service, and for sending informational e-mails to prospective clients, investors, and the general public, if requested.

Collection, Use, Disclosure of Information : IceStorm.com does not collect personally identifiable information about you unless you choose to provide us personally identifiable information through an online form or e-mail communication or you are accessing client-specific, secure content. We use cookies to ensure authorized access to client-specific secure content. Our use of cookies is explained in greater detail below. When accessing client-specific secure content, you are acting as a representative of your company and your interactions with our site in this capacity are governed by our relationship agreement with your company.

Our site also automatically creates logs regarding your and other user sessions on IceStorm.com, such as features that you use, the actions that you take, and the information that you access. We generally use this information in statistical and aggregate formats to assess the effectiveness of our site and to better understand your priorities and interests.

IceStorm.com does not sell, distribute or disclose your personally identifiable information collected from IceStorm.com to third parties without your consent. However, we may release information to a third party if required by a legal process such as a subpoena or a search warrant. Please note that visitors to IceStorm.com™ are not required to provide us personally identifiable information to use the public areas of our site. You can provide us information such as address, e-mail address, or telephone number if you would like to learn more about IceStorm.com products and services.

Use of Cookies : Cookies are pieces of data stored on a user’s hard drive that contain information about a user. In the case of secure content access, if your company is a client of IceStorm.com, we use a cookie that contains your login information, so we can ensure that client-specific information is secure from unauthorized access. We utilize an encrypted cookie to track client access to client-specific secure content. These cookies are used only for this purpose and are intended to be used only by our Web site. Please note that you can view and delete these cookies using the features of your browser.

Choice and Data Access : As a representative of your company, you can view and modify your company profile information in the secure client area of our site.

Data Security/Integrity : IceStorm.com has physical, electronic, and managerial security functions in place to protect personally identifiable information from loss, misuse, alteration or destruction. Only authorized employees have access to the data you provided and that access is limited by need. Our employees who have access to the data you provided have agreed to maintain the confidentiality of such information.

Children : IceStorm.com understands the importance of protecting children’s privacy in the online interactive world. This Web site does not intentionally target or solicit to children 13 and younger.

Notification of Changes : If we materially change our practices in handling personally identifiable information, as described in this statement, we will notify you by posting the changes on this Privacy Statement at least 30 days prior to their implementation.

AFFILIATE POLICIES:

An affiliate can only receive commission from selling our regular web hosting and reseller hosting services. We do not give commissions on domain registrations nor any other non-hosting service we provide. An affiliate can only receive commission if the referred customer has been active for at least 60 days. Referred customers must be active and account in good standing. Affiliates cannot earn commissions off accounts they sign up themselves. The referred customer must be a new customer. We have a right to reject any affiliate application and change these policies without any notice for any reason we see fit.
